Terms of Service
These Terms of Service (the “Terms”) govern your access to and use of ASH (also referred to as “The ASH Game”), an AI Dungeon Master service operated at theashgame.com (the “Service”) by [Your legal name or LLC name] (“we”, “us”, “our”, or the “Operator”). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Acceptance of these Terms
You confirm that you are at least 13 years old (or the minimum age in your country to consent to online services without parental supervision, whichever is greater). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
We may modify these Terms at any time. Material changes will be announced through the Service or by email at least 14 days before they take effect. Your continued use after the effective date constitutes acceptance of the modified Terms.
2. Description of the Service
ASH is a web application that orchestrates an AI Dungeon Master for tabletop role-playing games. The Service includes campaign creation, AI-generated narration, server-authoritative dice rolls, character and party management, AI image generation, and (on paid plans) text-to-speech narration. Features available to you depend on your subscription plan.
3. Accounts and Eligibility
You must register an account to use most of the Service. You agree to provide accurate information and to keep your password confidential. You are responsible for all activity under your account.
You may not create more than one account to circumvent plan limits, evade a ban, or exploit free-tier resources. If we detect such behavior we may suspend or terminate every related account.
4. Plans, Subscription, and Billing
ASH offers a free tier and paid subscription plans (currently ASH Pro and ASH Master). Each plan has explicit limits on monthly AI compute, image generation, campaigns, and player count. Limits are listed in your Account panel and may change with notice.
Subscriptions are billed monthly in advance through Paddle, Inc., which acts as the Merchant of Record. Paddle collects and remits applicable sales tax, VAT, and GST. The amount charged to your payment method may include those taxes based on your billing address.
Subscriptions automatically renew at the end of each billing period unless you cancel through the in-app Manage Subscription link, which redirects you to the Paddle customer portal. Cancelling stops future billing; you retain plan benefits through the end of the current period.
Refunds are governed by our Refund Policy.
5. Your Content; License Grant
Anything you submit, generate, or store through the Service — including campaigns, characters, narration, dialogue, art prompts, and chat — is “Your Content”. You retain ownership of Your Content. You represent that you have the rights to submit it and that it does not infringe third-party intellectual property, privacy, or publicity rights.
You grant us a worldwide, non-exclusive, royalty-free license to host, store, display, transmit, and process Your Content for the sole purpose of operating, securing, and improving the Service for you. This license terminates when you delete the Content or your account, except as preserved for the audit, tax, and dispute-resolution purposes described in our Privacy Policy.
We will not use Your Content to train models, sell advertising against, or share with third parties except as described in the Privacy Policy.
6. AI-Generated Content; No Warranty of Accuracy
The Service uses third-party large language models (currently Anthropic's Claude family) and image
generation models (currently OpenAI's gpt-image-1) to produce narrative, dialogue, dice
adjudication, and visual assets. AI output can contain factual errors, hallucinations, biases, or
unintended offensive material despite our prompt engineering and content controls.
You acknowledge that AI-generated content is provided “as is” for creative, recreational use. You will not rely on it for medical, legal, financial, safety, or other professional advice. The Operator makes no warranty that AI output is accurate, complete, current, lawful, or suitable for any particular purpose.
7. Acceptable Use
You agree not to:
- Use the Service to generate, store, or distribute content that is unlawful, defamatory, harassing, sexually explicit involving minors, terrorist, or that violates a third party's rights;
- Attempt to extract, reverse-engineer, or weight-steal the underlying AI models, prompts, or system prompts;
- Probe, scan, or test the vulnerability of the Service, except via a coordinated security disclosure described in Section 14;
- Use automated means (scrapers, bots, headless browsers) to interact with the Service in volumes inconsistent with normal human play, except for read-only access to public landing pages;
- Resell, sublicense, or redistribute access to the Service to other users without our written permission;
- Circumvent, manipulate, or evade plan limits, rate limits, account suspensions, bans, or billing obligations.
Violations may result in immediate suspension or termination, removal of offending content, forfeiture of pre-paid subscription fees, and (for repeat or serious violations) referral to law enforcement.
8. Moderation and Suspension
We may suspend, restrict, or terminate accounts that violate these Terms or pose a risk to other users, the Service, or our service providers. Where reasonable we will notify you and provide an opportunity to respond before suspending. In urgent cases (security threat, payment fraud, abuse) we may act immediately.
Suspended users keep read-only access to their campaigns where technically possible; banned users lose access entirely. We may cancel any active subscription on a banned account; future billing stops. See also our Refund Policy for whether and when fees are returned.
9. Termination by You
You may stop using the Service at any time. To delete your account permanently, use the Delete Account button in the My Account panel. Account deletion is irreversible: every campaign you own and your character entries in other people's campaigns will be permanently deleted; your user row will be anonymized. Limited financial and audit data is retained for tax and dispute resolution per our Privacy Policy.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, OR THAT AI OUTPUT WILL BE ACCURATE, RELIABLE, OR APPROPRIATE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEITHER THE OPERATOR NOR ITS SERVICE PROVIDERS WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR USE), EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THE OPERATOR'S TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (a) USD $100 OR (b) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions our liability is limited to the maximum extent permitted by law.
12. Indemnification
You agree to indemnify, defend, and hold harmless the Operator and its affiliates, employees, and service providers from any claim, demand, damage, loss, or expense (including reasonable attorneys' fees) arising out of or related to (a) Your Content, (b) your use of the Service, (c) your violation of these Terms, or (d) your violation of any third-party right, including intellectual property, privacy, or publicity rights.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of [Your State], United States, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be resolved exclusively in the state or federal courts located in [Your County], [Your State], and you consent to the personal jurisdiction of those courts.
Before filing any formal complaint, you agree to make a good-faith attempt to resolve the dispute by emailing support@theashgame.com and giving us at least 30 days to respond.
CLASS-ACTION WAIVER: TO THE EXTENT PERMITTED BY LAW, ANY DISPUTES MUST BE BROUGHT IN AN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.
14. Security Disclosure
We welcome responsible security disclosures. If you discover a vulnerability, email support@theashgame.com with technical details. Please do not disclose publicly until we have confirmed a fix is deployed. We will credit reporters who request it and we will not pursue legal action against good-faith researchers acting under this section.
15. Copyright Complaints (DMCA)
If you believe content on the Service infringes your copyright, send a notice to support@theashgame.com with: (a) identification of the copyrighted work, (b) the URL or location of the alleged infringement, (c) your contact information, (d) a statement made under penalty of perjury that you have a good-faith belief the use is not authorized, and (e) your physical or electronic signature. Misuse of the DMCA process may result in liability to you under 17 U.S.C. § 512(f).
16. General
These Terms, together with the Privacy Policy and the Refund Policy, constitute the entire agreement between you and the Operator regarding the Service. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a right is not a waiver of that right. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
